Terms of Service

Welcome to Watchpost. These Terms of Service ("Terms") govern your access to and use of the Watchpost web application, website, and related services (collectively, the "Service"), operated by Watchpost LLC ("we," "us," or "our").

By creating an account, subscribing to a plan, or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

1. Description of Service

Watchpost provides a business-to-business (B2B) software platform designed to monitor the professional licensing and compliance status of your field personnel. The Service automatically cross-references user-submitted roster data with publicly available state registry databases and delivers automated notification alerts.

2. Subscription, Billing, and Cancellations

Subscription Model: Access to the Service is provided on a recurring subscription basis (monthly or annually).

Payment Processing:All billing and payment processing are handled securely by our third-party payment processor, Stripe, Inc. By subscribing, you agree to Stripe's Services Agreement and authorize regular recurring charges to your payment method.

No Raw Payment Storage: We do not store or process your raw credit card data on our servers.

Cancellation: You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access will continue until the end of your current paid billing period.

Refunds: Except as required by law, all subscription payments are non-refundable.

3. Communications and Twilio SMS Terms

By providing your phone number and onboarding your team to Watchpost, you explicitly consent to receive transactional and operational communications via automated text messages (SMS) and email alerts.

SMS Infrastructure: Short Message Service (SMS) notifications are delivered via our infrastructure partner, Twilio, Inc.

Message Purpose: Text messages are strictly operational (e.g., immediate notifications regarding upcoming credential expirations, critical state registry status updates, or account security access codes). We do not send promotional or marketing text messages.

Opt-Out: You can opt out of receiving text messages at any time by replying STOP to any text message received from us. Please note that opting out of SMS alerts may severely impact your ability to receive real-time compliance updates regarding your field crew.

Carrier Rates: Standard message and data rates applied by your mobile carrier may apply.

4. Email Communications

Transactional emails (such as invoice receipts, password resets, and detailed compliance roadmaps) are dispatched via our email delivery partner, Resend, Inc. You agree to maintain an accurate, monitored administrative email address on your account profile.

5. Third-Party Data Disclaimers (State Registries)

Watchpost aggregates data from public government and state licensing registries.

No Control Over External Records: We have no direct control over the uptime, accuracy, completeness, or operational availability of third-party state registry databases.

Data Scrape Lag: Information displayed on the Service is subject to update frequencies and database syncing schedules.

User Verification Duty: The Service is an automated operational tool, not a substitute for professional legal or regulatory counsel. You retain ultimate responsibility for manually verifying that your personnel are legally cleared to perform work under local regulations.

6. Limitation of Liability

To the maximum extent permitted by law, Watchpost LLC, its officers, and its infrastructure partners (including Stripe, Twilio, and Resend) shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, any loss of profits, lost revenue, data corruption, job site shutdowns, general contractor contract lockouts, or state board fines resulting from:

  • Your use of or inability to use the Service.
  • Any errors, omissions, inaccuracies, or delays in state registry tracking data.
  • Temporary downtime or operational outrages of the Service or its third-party sub-processors.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. Any legal action arising under these Terms must be filed in the state or federal courts located in Kentucky.
